Terms of Use

Effective September 1, 2020

Hise Scientific Instrumentation, LLC (HSI) provides software services for products (Products) listed below according to these Terms of Use. By using Products, you agree to these terms. It may be requiredthat we change these terms, in which case, you will be notified by the email address we have. Any user to be found in violation of these terms may have their account suspended.

The use of software services located through the following URLs represent the Products:

  1. User Accounts
    1. In order to use our Products, you must create a user account. Users must be 13 years of age or older. See the HSI Privacy Policy for more information on what data we collect.

    2. Users must provide a valid email address.

  2. User Content
    1. User Content is any content or information provided by you. This includes file uploads, comments and any other information you provide. All User Content provided by you must be lawful.

    2. Users may not provide any user content considered to be SPAM or marketing materials.

    3. Users may not provide any user content considered to be sexually explicit.

    4. Users may not provide any user content that could be considered abusive.

    5. Users may not provide any executable source code for the purposes of exploitation or disruption of data or system services.

    6. If anyone brings a claim against HSI related to User Content that you provide, you will indemnify and hold HSI harmless from and against all damages, losses and expenses of any kind arising out of such claim.

  3. Application Use
    1. Users may not utilize the system in a way in which it was not designed to be used.

    2. Users may not reverse engineer any software provided by HSI.

  4. Payments and Billing
    1. For subscription services, users will be billed monthly or yearly, as specified by the user.

    2. Users may terminate their subscriptions at anytime, refunds will be prorated for the remaining period of the subscription term.

    3. To terminate your subscription, simply email info@hisescientific.com.

  5. Data Retention and Warranties
    1. Whilst HSI makes every effort to retain and store data provided by you and collected through HSI products, we disclaim any warranty against the loss of data. HSI provides mechanisms for users to download and retain their data. By using HSI Products, you hold HSI harmless against any claim related to loss of data or information stored on computer systems.

    2. Services and content are provided “as is” and with “all faults”. We disclaim any warranties, including but not limited to the warranties of merchantability and fitness for a particular purpose.

  6. Limitation of Liability
    1. To the maximum extent permitted by applicable law, HSI shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits orrevenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible loses resulting from (i) your access to or use of or inability to access or use the Products; (ii) any conduct or content of any third party on the Products, including without limitation, any defamatory, offensive or illegal conduct of other users or third parties; (iii) any content obtained from the Products; or (iv) unauthorized access, use or alternation of your transmissions or content. In no event shall the aggregate liability of HSI exceed the amount you paid to HSI in the past 12 months for the Products giving rise to the claim. The limitations of this subsection shallapply to any theory of liability, whether based on warranty, contract, statute, tort (including negligence) or otherwise, and whether or not HSI have been informed of thepossibility of any such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
